Equal Pay for Equal Work Effective April 1, 2018 April 02 2018
Employers in Ontario should be aware that effective April 1, 2018 employees, regardless of status (FT, PT, Casual, etc.), are entitled to receive the same rate of pay when:
- They perform substantially the same kind of work in the same establishment;
- Their performance requires substantially the same skill, effort, and responsibility; and
- Their work is performed under similar working conditions.
Temporary help agency employees doing the same job as permanent employees at the agencies’ client companies must also receive equal pay.
With that said, employers will be exempt from the new equal pay for equal work rules if the difference in wage is made based on a merit system or seniority system, systems that measure earnings by quantity or quality of production, or other bona fide factors (gender and employment status will not qualify).
- Ils effectuent substantiellement le même type de travail dans le même établissement;
