Equal Pay for Equal Work Effective April 1, 2018 April 02 2018

Employers in Ontario should be aware that effective April 1, 2018 employees, regardless of status (FT, PT, Casual, etc.), are entitled to receive the same rate of pay when:

  • They perform substantially the same kind of work in the same establishment;
  • Their performance requires substantially the same skill, effort, and responsibility; and
  • Their work is performed under similar working conditions.

Temporary help agency employees doing the same job as permanent employees at the agencies’ client companies must also receive equal pay.

With that said, employers will be exempt from the new equal pay for equal work rules if the difference in wage is made based on a merit system or seniority system, systems that measure earnings by quantity or quality of production, or other bona fide factors (gender and employment status will not qualify).

Les employeurs de l'Ontario doivent savoir qu’à compter du 1er avril 2018, les employés, peu importe leur situation d’emploi (temps plein, temps partiel, occasionnel, etc.), ont le droit de recevoir les mêmes taux de rémunération quand :

  • Ils effectuent substantiellement le même type de travail dans le même établissement;
  • Leur performance exige sensiblement les mêmes compétences, efforts et responsabilités; et
  • Leur travail est effectué dans des conditions de travail similaires.

Les employés d'agences de placement temporaire qui font le même travail que les employés permanents des entreprises clientes des agences doivent également recevoir un salaire égal.

Cela dit, les employeurs seront exemptés des nouvelles règles en matière d’égalité salariale si la différence de salaire est basée sur des critères d’ancienneté ou de mérite, des systèmes qui mesurent les gains par quantité ou qualité de production ou d'autres facteurs de bonne foi (le genre et la situation d’emploi ne seront pas admissibles).


Ontario - Ministry of Labour Releases New ESA Poster February 09 2018

The Ministry of Labour has revised and released the ESA poster which requires all Employers to post in a conspicuous place where it is likely to come to the attention of all employees.  The revised poster reflects the significant changes that are now in effect due to Bill 148, the Fair Workplaces, Better Jobs Act.  In addition to posting the ESA poster, Employers should be reminded of the following responsibilities:

  • Provide a copy to employees who are covered under the ESA;
  • Provide a copy to new hires within 30 days of hire;
  • Provide a copy of the poster in a language other than English if requested by the employee.
