Alberta: New Information Sheet for Employer’s seeking to Avoid Religious Discrimination June 09 2016
At the beginning of April, 2016, the Alberta Human Rights Commission released an interpretive information sheet detailing the protections surrounding religious beliefs afforded to people under the Alberta Human Rights Act. The information contained applies to all relevant aspects of human rights law, including employment practices.
The publication goes into detail explaining:
- What the phrase “Religious Beliefs” means
- What is “Discrimination” based on religious belief
- The duty to accommodate the beliefs of others
- The necessary respect for religious diversity
- Relevant Supreme Court decisions on the topic
Among other important lessons, the publication explains how rules that are, at first glance, “neutral” (i.e. targeting all groups equally), may have unforeseen implications for employees of different religious backgrounds.

Alberta : Nouveau bulletin d’information à l’intention des employeurs qui cherchent à éviter la discrimination religieuse
Au début du mois d’avril 2016, la Commission albertaine des droits de la personne a publié une fiche d’interprétation précisant les mesures de protection entourant les croyances religieuses accordées aux gens en vertu de la Loi de l’Alberta sur les droits de la personne. Les informations qu’elle contient concernent tous les aspects relatifs à la loi sur les droits de la personne, y compris les pratiques d’emploi.
La publication présente en détails :
- Ce que signifie l’expression « Convictions religieuses »
- Ce qu’est la « Discrimination » fondée sur la croyance religieuse
- L’obligation d’accommoder les croyances d’autrui
- La nécessité du respect de la diversité religieuse
- Les arrêts de la Cour suprême sur le sujet
Parmi ces nombreux enseignements, la publication explique comment des règles qui sont, à première vue, « neutres » (c'est-à-dire qui ciblent tous les groupes également), peuvent avoir des conséquences imprévues pour les employés de différentes traditions religieuses.
